March 28, 2000
Dr. Robert White, expert testimony, Ohio R. Evid. 703, motion in limine, plaintiff's filing
Estate sought to limit the testimony of Dr. Robert White’s expert medical opinion pursuant to rule 703 of the Ohio Rules of Evidence. Plaintiff asserted that Dr. White’s testimony cannot exceed those "facts or data either perceived by him or [already] admitted into evidence." Plaintiff argued that Dr. White based his investigation on transcripts from witnesses who have yet to testify and other outside material not admitted as evidence.
