Abstract

Earlier this week, the Colorado Supreme Court issued a historic decision. The court disqualified, for the very first time, a former president from appearing on the ballots of the 2024 presidential election. In a carefully crafted 4-3 opinion, the court held that all the requirements of Section 3 of the 14th Amendment (the so-called “Insurrection Clause”) have been met, and therefore, that former President Donald Trump is ineligible to run again for the highest office in the land.
