Abstract
This article will examine the Brentwood Academy case that has been before the federal courts now for almost a decade. The discussion of the legal issues regarding this case will be divided into three parts: a summary of the facts and the litigation regarding plaintiff's state action and constitutional claims; a review of the Supreme Court's recent decision: and, an analysis of the implications of that decision as to the interpretation of constitutional rights, the operation of state athletic associations, and the rights of private schools.
