Abstract
The State of Ohio’s response to the Estate of Sam Sheppard’s position that the body of Marilyn Sheppard should not be exhumed. The State argues that the prosecutor, under the authority of Ohio law, has the right to order the exhumation of any body and that doing so is not an abuse of discretion by the prosecutor or the court.
The Estate later withdrew its motion to prevent the exhumation. See the court's order of 9/9/1999 in the docket
