Abstract
This motion by the Estate of Sam Sheppard is for an evidentiary hearing to investigate the whereabouts of evidence that has been lost or destroyed by the State over time. The Estate claims that the evidence was wrongfully destroyed by the State after Sam Sheppard was acquitted in 1966. Various options for sanctions against the State are proposed as a remedy for this alleged spoliation of evidence. The Estate wishes to address these issues in an evidentiary hearing.
