Abstract
The State requested that the court compel the discovery testimony of Gary Dunn pursuant to Ohio Civil Rule 37. The State argued that Mr. Dunn was asked to testify about what he was told by Richard Eberling about the Marilyn Sheppard case, but refused to testify on that subject at deposition. His name appeared as a possible witness for the Sheppard Estate, and in this motion, the State request that Mr. Dunn be compelled to give discovery testimony, or in the alternative, not be permitted to testify.
