Abstract
This motion was filed by investigative journalist and author James Neff to quash a subpoena by the State and the Sheppard Estate. Neff began to investigate the murder of Marilyn Sheppard in 1989 with plans to publish his findings in a book titled, “Chasing the Fugitive”, with Random House Publishing. He argued that compelling him to testify, and make public the results of his investigation and research, prior to publication, would interfere, and likely injure, his livelihood as a self-employed investigative journalist. Neff asks the court not to compel him to testify, or in the alternative to compensate him for his testimony.
